DQLink Terms of Service
DRAFT — attorney review required.
These Terms of Service ("Terms") govern use of the DQLink website and application at https://dqlink.pro (the "Service"), operated by Four G Holdings and Developing LLC, a Texas limited liability company ("DQLink", "we", "us"). Business customers who sign an Order Form are also bound by the DQLink Master Subscription Agreement; if there is a conflict, the Master Subscription Agreement controls for that customer.
1. Who may use the Service
The Service is for motor carriers, their staff, their drivers and applicants, and auditors those carriers invite. You must be at least 18. If you use the Service for a company, you confirm you are authorized to act for it.
2. Accounts and security
You are responsible for activity under your account. Keep your password and two-factor codes private. Company administrators must use two-factor authentication. Tell us right away at support@dqlink.pro if you suspect unauthorized access.
3. Drivers and applicants
If you are a driver or applicant, your employer (or prospective employer) controls the records it collects about you through DQLink and is responsible for its use of them. Questions about your file, corrections, or copies of records should go to that employer first. You agree that information you provide is true and complete; federal rules (49 CFR 391.21) require accurate employment applications.
4. Electronic signatures and records
By signing documents in DQLink you agree to do business electronically. Your typed name and drawn signature are your legal signature under the federal ESIGN Act and the Texas Uniform Electronic Transactions Act. You may request a paper copy of any document you signed from the company that asked you to sign it. You can withdraw consent to electronic records by contacting that company, which may then need to complete the process on paper.
5. Acceptable use
You must follow the DQLink Acceptable Use Policy. We may suspend accounts that violate it.
6. Not legal advice; no certification
DQLink helps organize records required by FMCSA but is not certified by FMCSA or the U.S. Department of Transportation and does not give legal advice. Carriers remain responsible for their own compliance.
7. Intellectual property
We own the Service, including its software, design and training content we provide. Companies own the data they put in. Feedback you give us may be used without obligation.
8. Third-party services
Some features use third parties (for example MVR providers, FMCSA systems, email delivery and Stripe payments). Their terms apply to their services.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES AND ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO ANY USER WHO HAS NOT SIGNED A SEPARATE AGREEMENT IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
10. Changes and termination
We may update these Terms; material changes will be posted here with a new effective date. We may suspend or end access for violations. Companies' rights to export their data are described in the Master Subscription Agreement.
11. Governing law
These Terms are governed by Texas law. Disputes will be resolved in the state or federal courts located in [County], Texas.
